By creating an account or using the NestMate application or website ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. MEDICAL DISCLAIMER - PLEASE READ CAREFULLY

NESTMATE IS NOT A MEDICAL DEVICE. THE SERVICE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY.

• NOT MEDICAL ADVICE: Any data tracked and any insights provided by our AI ("Nesti"), sleep analysis, or symptom guidance are NOT medical advice, diagnosis, or treatment.
• CONSULT A PROFESSIONAL: Always seek the advice of your pediatrician or other qualified health provider with any questions you may have regarding a medical condition.
• EMERGENCIES: NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ ON NESTMATE. IF YOU THINK YOUR CHILD HAS A MEDICAL EMERGENCY, CALL 911 IMMEDIATELY.
• AI LIMITATIONS: AI can make mistakes or "hallucinate" incorrect information. Do not rely on AI-generated insights for health decisions.

3. User Accounts & Family Sharing

You are responsible for safeguarding your account and for all activities under your account. Family sharing allows you to grant access to other caregivers; you are responsible for the actions of those you invite.

4. Subscriptions and Billing

Certain features require a paid subscription. All fees are non-refundable except as required by law. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

5. User-Generated Content

You retain ownership of the photos, audio recordings, transcriptions, and data you upload. You grant NestMate a license to host and process this content solely to provide the Service to you and your family.

6. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

7. Acceptable Use Policy

You agree not to use the Service for illegal purposes, attempt to abuse the AI systems, or reverse engineer the software.

8. Intellectual Property

All rights in the Service (excluding User Content), including software, designs, and the "Nesti" brand, are the property of NestMate.

9. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. NESTMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
